The Association for Human Rights Legal Aid
instituted proceedings before the Administrative Court
in
order to obtain a formal copy of a torture case of a family in Helwan.
In
7/6/2004, the Association for Human Rights Legal Aid instituted proceedings
before the Administrative Court of the no. 23692 of the juridical year 58,
against the Mr. Consultant the Ministry of Justice, and Mr. Consultant the
Attorney General, and Mr. Consultant the Deputy Director of South Cairo
Prosecutions, and Mr. Chief of Helawn Prosecution. The suit demands to
obtain immediate ruling of obligating the Public Prosecution to delivering
the lawyers of AHRLA as a legal representatives of the victims a formal copy
of the inquiries papers and the testimonials of the witnesses and the
policemen.
The involved law case is about the breaking in some citizens’ homes by the
police investigation of Helwan, as searching for their relative who accused
of murder crime, they all have been arrested and detained in Helwan police
station in order to force them to confess of the place of their accused
relative, it is very clear that all these practices are contrary to the
institution and the international conventions for human rights, because all
these innocent person were exposed to the most awful kinds of torture and
terror like beating the men harshly, and abuse the women and rape some of
them.
The law case has been sent to the South Cairo Prosecution under secret
numbers that has no specific legal sense, so the Association ( AHRLA)
considered the resolution, that prevents the lawyers from obtaining a
formal copy of the case papers, as an administrative resolution, and as a
result of that it is possible to appeal it before the Administrative Court.
In
that context, the Association expresses its deep concern about the role
played by the Prosecution of Helwan in violation of the defending and sues.
That action made by the Association towards this law case is untraditional,
and we resorted to the Administrative Court, because it is the court of
legitimacy, and we hope that the authority make legal principle about the
resolutions of the Public Prosecution in similar cases.
The Association also calls for all human rights organizations to support it
in order to make trail of the officers who have committed these torture and
authority misuse crimes.
