The Court order: staying the execution of Al-Giza governor’s decision

The Administrative Causes Court, Capita Disputes 1st Circle, in its public session, On Tuesday 8/12/2003 its verdict to stay the execution of the Giza governor’s decision to collect the cleanness fees on the electricity bill.
AHRLA considers the verdict a new victory in its history. As AHRLA had submitted the objection No 19680/ judicial year No57.administrative judiciary on behalf of Neseem Habib Wasef versus the capacity of Al- Giza Governor and the capacity of the chairman of the Holding Company for Electricity. AHRLA demanded urgently staying the execution of the objected decision issued by the defendant for its being unconstitutional. The objection session was appointed in 17/6/2003, then the case was postponed for several times, to complete the files. During that time, many claimants, Al-Giza residences joined.
In today’s session, the court decided to urgently stay the execution of the objected decision, to execute the draft of the sentence with out declaration and to refer the case to the state’s proxy authority. People received the sentence with applauds and hailing: “viva justice”
AHRLA believes that imposing cleanness fees haphazardly and obligatory adding it on the electricity bill is equal to unrightfully collecting money, trespassing and trumping on from the executive authority to the legislative authority, which is the only authority authorized to impose taxes. Imposing the cleanness fees on the electricity bill is an injustice for citizens specially under the current deteriorating economic state and the rise in the citizens’ burdens.
We do not forget, in this context to hint to the corruption suspected in the process of giving some foreign companies the authority to collect rubbish and also to collect the fees which were added to the electricity bill. So, AHRLA is repeating the call to the Egyptian Parliament to form a facts-finding committee on that matter, in convenience with the reports issued by the specialized bodies in the state on the subject of bribe and corruption crimes. These crimes were prevailed to reach 76 thousands with a value of L.E 11 Milliards., while there is 90% of unreachable crimes. Moreover, the rate of money laundry is estimated as 9% of the domestic product, and also 30% of the unofficial economy that reached about L.E 7.1 Millliards in 1999/2000
AHRLA, while waiting for the administrative causes court sentence in the claim subject asks Al-Giza governor not to put off in executing the judiciary sentences in order to respect the law dominion mutually between state and citizens.
