The legal medicine assures of the
citizen’s death
As a result of torturing by electricity
And the public prosecution demands capture of
The Security State Investigation accused officer,
But the Ministry of Interior refused the execution.
The Association for Human Rights Legal Aid [AHRLA] expresses its high
annoyance about not execution of the public prosecution of Alkobba Gardens’
resolutions, it is 3 resolution up till now, Such resolutions demand to
catch the police officer/Ashraf Safout, the officer in Public Prosecution
Investigation, It came from the background of the investigation the case of
torture the citizen Mohammed Abdel Kader Alsayed 31 years old and his
brother Sameh 27 years old in Alkobba Gardens Police station in September
2003, which leads to the first victim’s death.
The Association has published an immediate press release in 30/9/2003
about this case under the title “The Series of Torture Sill Continuing”, All
that happened after detention of the two brothers from 14/9/2003 to
21/9/2003, And then their family have informed that they have to come to the
police station to bring the two brothers, But they found only Sameh, And
Mohammed was in the Alssahl Hospital where they knew that their son Mohammed
is dead and his corps in Zinhom Morgue, the father has been forced to make
death certificate for his son dated in 21/9/2002 from the health office of
Zinhom Morgue and buried him in Zinhom cemeteries.
The report of Legal Medicine dated in 21/3/2004 assured the suspicions of
the victim’s family that he died from torture by the police officers of
Alkobba Gardens, The report has assured also what the Association’s
communiqué to the Attorney General when it confirmed that:
1- There are contusions and redness in the lowest lip and the right cheek
and the left arm and right arm and the left leg, there are also contusions
in the back and chest, all these contusions are made frictionally and
traumatisms, and occurred as a result of hitting by hard bodies.
2-There are also a burning in the nipples of right and left breasts and
in the lowest lip and in the penis, all these burnings are thermal mostly
resulted from touching electric current by electric wire.(It is worth
mentioning that the death happened within the 8 hours after these injuries)
Coming under that thermal source was the reason of blood circulation sharp
downfall that leaded to death. The same report asserted that the victim had
no infections of any kind, the report matched what the father and the
brother of the victim have said about the blueness over all the body of the
victim, and they also a break in the skull when they went to the morgue, and
there were another person was detained in the same room said that when he
saw the victim for the first time he has no injuries, but from time to time
the officers called him and he returned after a longtime with many injuries
and in very bad situation.
The question is how it has been ignored the resolution of the authority
of Public Prosecution to continue the investigations about the mentioned the
event? The officer did not execute the resolution of capture, the matter
that comes along with the disability of the Public Prosecution to execution
of its resolutions! And the Ministry of Interior’s implied approval of
ignoring the resolutions. At the same time the government gathers its
forces against normal and simple people in order to execute trivial fines,
Where is the Rule of law towards all these violations committed by the
persons who suppose to execute it.
The Association for Human Rights Legal Aid show this case before the eyes
of The Attorney General and the Minister of Interior, And appeal them to
respect the trust of Prosecution and the authority of Public Prosecution
which represents the whole society.
